Frequently Asked Questions.
What is a family trust?
A family trust is a legal arrangement where assets, such as the family home, are held by trustees for the benefit of chosen beneficiaries. It can help with asset protection and succession planning, but it isn’t right for everyone. We talk through your situation and explain whether a trust suits your goals.
Is my existing trust still fit for purpose?
Many trusts were set up years ago for reasons that may no longer apply. The Trusts Act 2019 also introduced new duties for trustees, including keeping core trust documents and providing certain information to beneficiaries. A review helps confirm your trust is working as intended and being managed correctly.
What are my responsibilities as a trustee?
Trustees must act in line with the trust deed, honestly and in good faith, and for the benefit of the beneficiaries. That includes keeping proper records, making decisions jointly with any co-trustees, and avoiding conflicts of interest. We explain your obligations clearly and support you in meeting them.
Can a trust be wound up?
Yes. A trust can usually be wound up once it has served its purpose or is no longer needed, provided this is done in line with the trust deed. We guide trustees through the process, including distributing assets and any property or tax considerations.

Trusts Built Around You.
No two trusts are the same. The right structure depends on your family, your assets, and what you want to achieve now and in the future. A trust often works alongside your will, enduring powers of attorney and wider succession plans.
We take the time to understand your goals, explain your options in plain language, and help make sure your trust keeps working as your circumstances change.
